Terms of Service

1. Acceptance of Terms

Welcome to NFC Forge. These Terms of Service ("Terms") govern your use of the NFC Forge mobile application ("App", "Service") operated by Michel Anderson Lutz Teixeira ("we", "our", or "developer").

By downloading, installing, accessing, or using NFC Forge, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you may not use the App.

2. Service Description

NFC Forge is a mobile application that allows users to create, write, and manage NFC (Near Field Communication) tags on their iOS devices. The App offers free basic features and premium features through subscription.

3. Eligibility

To use NFC Forge, you must:

• Be at least 13 years of age (or the minimum age required in your jurisdiction)
• Have a compatible iOS device (iPhone 7 or later) with NFC support
• Have iOS 17.0 or later installed
• Have the legal capacity to agree to these Terms

If you are a minor, you must have permission from a parent or guardian to use the App.

4. Acceptable Use

You agree to use NFC Forge only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the App for illegal or unauthorized activities
• Write content to NFC tags that is illegal, defamatory, obscene, threatening, or violates third-party rights
• Write URLs or content containing malware, viruses, or malicious code
• Attempt to deceive or harm other users or third parties
• Use the App for spam or fraudulent activities
• Modify, adapt, reverse engineer, or decompile the App
• Remove or alter copyright notices or other proprietary marks
• Use the App in a way that may damage, disable, overburden, or compromise our servers or networks
• Attempt to gain unauthorized access to the App or related systems

5. Subscriptions and Payments

5.1. Premium Features

NFC Forge offers a free version with limited features and a premium subscription ("Premium") that unlocks additional features, including:

• Unlimited saved tags
• Production mode for bulk writing
• Chip password protection
• Other exclusive features added regularly

5.2. Subscription Purchase

Premium subscriptions are processed through the Apple App Store using StoreKit. All payment transactions are managed by Apple, not by us. You agree to Apple's App Store Terms and Conditions when making a purchase.

5.3. Automatic Renewal

Premium subscriptions automatically renew at the end of each period (monthly or yearly), unless you cancel at least 24 hours before the end of the current period. Payments will be charged to your Apple account upon purchase confirmation.

5.4. Cancellation and Refunds

You may cancel your subscription at any time through your Apple account settings. Cancellation will take effect at the end of the current billing period.

Refunds are processed by Apple according to their refund policy. To request a refund, contact Apple Support.

6. Intellectual Property

NFC Forge, including its source code, design, graphics, logos, and other materials, is the property of the developer or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, and revocable license to use the App on your personal devices, subject to these Terms.

You retain all rights to content you create using the App (NFC tags, URLs, etc.).

7. Privacy

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is an integral part of these Terms.

8. Limitation of Liability

In no event shall we be liable for:

• Direct, indirect, incidental, special, or consequential damages resulting from use or inability to use the App
• Loss of data or information stored through the App
• Damages resulting from use of NFC tags written with the App
• Service interruption or technical failures
• Actions of third parties or unauthorized use of the App

Our total liability to you shall not exceed the amount paid by you for the Premium subscription in the past 12 months, or $0 if you only use the free version.

9. Disclaimer of Warranties

NFC Forge is provided without warranties of any kind, whether express or implied, including but not limited to:

• Merchantability warranties
• Fitness for a particular purpose
• Non-infringement of rights
• Accuracy, reliability, or timeliness of the App

10. NFC Tag Compatibility

NFC Forge is compatible with standard NDEF NFC tags, including:

• NTAG213, NTAG215, NTAG216
• Ultralight EV1 (for password protection)
• Other NFC tags compatible with NDEF standards

We do not guarantee compatibility with all brands or models of NFC tags. Chip password protection is only available for NTAG21x and Ultralight EV1 chips.

11. Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the App, including features and functionality, at any time, with or without notice. We shall not be liable to you or any third party for such modifications, suspensions, or discontinuations.

12. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you violate these Terms.

Upon termination, your right to use the App will cease immediately. All provisions of these Terms that, by their nature, should survive termination shall continue in effect after termination.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of Brazil, without regard to its conflict of law provisions.

Any dispute relating to these Terms shall be resolved in the competent courts of Brazil.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the new Terms on this page and updating the "Last Updated" date.

It is your responsibility to review these Terms periodically. Continued use of the App after changes constitutes your acceptance of the new Terms.

15. General Provisions

15.1. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of NFC Forge.

15.2. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15.3. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
